OODWISE nt Gambier is proud to partner with dWise to help reduce food waste in your 625005 4 - The Border Watch, Wednesday, November 27, 2013 On On June 2 at around 12.50pm on a Sunday, a witness noticed the defendant driving a black SS Commodore utility erratically along Southern Ports Highway near Rendelsham. Mitchell approached a vehicle driven by the witness, apparently attempting to overtake. The witness said Mitchell was so close they could not see his headlights and pulled over to let the car pass, but the defendant was too close and collided with their vehicle. The witness’ vehicle was spun around and came to a rest on the wrong side of the road, while Mitchell proceeded into a paddock, where his car rolled and stopped at an embankment. Police arrived, along with emergency services, and the defendant was treated at the scene. He was diagnosed with a dislocated shoulder three weeks later and required major surgery. Police said the fears of the ... two people’s lives have been put at risk Magistrate Paul Foley driver travelling ahead of Mitchell were reasonable. A blood test confi rmed he had drugs in his system and his car was impounded. Defence counsel Heidi Hancock said her client had been at a party the night before and that he had smoked “ice”. She said Mitchell received a ride home at around 3am and was well rested before driving nine hours later. Crashes lead to police reports PENOLA police reported a 25-year-old man from Kalangadoo on Sunday for driving while disqualifi ed following a crash earlier this month at Mount Gambier. The reported man will be summonsed to attend court. In other news, a drink driver and a motorcyclist riding without a licence were caught earlier this month in the region. Police reported a 23-year-old man from Penola for driving unlicensed, driving without due care, plus drink and drug driving on November 15 following a road crash in September. The reported man allegedly registered a blood alcohol level of .070 and also tested positive to methamphetamine at the time of the crash. Kalangadoo police also stopped an 18-year-old man from Tarpeena riding a motorbike on the same day. Checks revealed the man had never held a licence and the motorbike was both unregistered and uninsured. “Road safety is everyone’s responsibility and where a driver increases the risk of a fatal or serious crash occurring they will face serious penalties,” Senior Constable First Class Nick Patterson said. Motorists avoid serious injuries EMERGENCY service crews attended a two-car collision near Glenroy on Monday night. Penola and Coonawarra Country Fire Service (CFS) crews were called to the accident at about 5.30pm. Police and ambulance crews also attended the collision at an intersection on Glenroy Maaoupe Road. There was a single male occupant in each vehicle and no serious injuries were sustained, although one man was transported to the Penola Hospital, where he received treatment for cuts to his head. Mr Foley had no sympathy for the defendant, questioned his driving and aired his frustration at seeing another drug driver in court. “He was tailgating, which was very dangerous,” he said. “I’m not with you on the submissions as two people’s lives have been put at risk. “We have another driver that uses methylamphetamine. “I take into account it wasn’t just one occasion he was speeding up to the car and he was so close the witness couldn’t see the headlights. “It was a pattern of bad driving compared to a momentary lapse.” The magistrate said the offence was serious and that he would put the case off until the next Millicent court date on December 18. “I’m thinking about the prospect of imprisonment and I need to think as this is regarded as very serious,” Mr Foley said. Drink drive allegation A MELBOURNE man was arrested and charged with exceeding the prescribed concentration of alcohol and driving unlicensed in Mount Gambier on Monday. Police stopped the man at about 4pm and he submitted to a breath test, recording a reading of 0.082. The 20-years-old’s car was impounded for 28 days and he was issued a sixmonth instant loss of licence. He was bailed to appear in court. In an unrelated incident, a 36-yearold Mount Gambier man was reported for breaching his probationary licence conditions, failing to produce his licence and driving under the infl uence of drugs after testing positive to methamphetamine.
